Exchange-Led Certification
Responsibility sat with exchanges under the Rule 40.3 framework. The chair described the stock-based perpetuals as deemed cleared after that self-attestation step, without a vote of the full commission.
Stock Selection Left Open
Stock selection fell to the exchanges themselves. The agency set the gate as CFTC contract market status plus SEC notice filing, and it listed no specific venue.
Two Core Features
Two features mark the format. Funding payments flow at set intervals to keep contracts near the stock, and leverage magnifies exposure, while the absence of expiry allows positions to remain open.
Onshore Over Offshore
The chair cast the clearance as a way to steer Americans toward regulated U.S. markets. Protection of those traders served as the central argument, with offshore venues as the alternative being displaced. That reasoning ran through the chair’s remarks.
Payments That Anchor
Payments flow between opposing positions on a schedule. When the contract drifts above or below the stock, those transfers pull it back in line.
Bitcoin Came Before
The decision followed an earlier CFTC clearance for a bitcoin perpetual. The chair called that bitcoin step a milestone and presented the stock contracts as building on it. Stocks became the next asset class to receive the format.
Native to Crypto
Crypto pioneered the perpetual long before stocks were involved. Decentralized platforms and offshore exchanges turned it routine for bitcoin and ether, and the new step applied it to company shares. Crypto markets demonstrated the design could function at scale.
A Memorandum Paves the Way
Earlier this year, both agencies put their coordination terms in writing. The chair said that step ended the jurisdictional disputes that had long surrounded such derivatives. The written terms helped the two bodies to act in concert on the stock perps.
Shared Jurisdiction
Jurisdiction over the contracts was divided between the futures and securities regulators. A category created by federal futures legislation governed such products, though tension between agencies long kept it sparse.
Recognition for the Format
The perpetual gained standing in U.S. regulation through this step. For digital asset markets, that recognition could support broader domestic availability of crypto perps.
Work Still Ahead
The rollout remained pending. No exchange or stock list had been published, leverage caps were unsettled, and venues still owed SEC notice filings.
